These Terms of Service govern your use of superiorfundding.com and any related services provided by Superior Funding. By using the site, you agree to these terms. If you do not agree, please do not use the site.
Superior Funding is a loan-matching service that connects qualified borrowers with a network of independent partner lenders. We are not a direct lender. We do not make credit decisions, set interest rates, or service loans. The lender that approves your application is responsible for all aspects of the loan, including disclosures, servicing, and collection.
You must be a United States resident at least 18 years old (19 in Alabama and Nebraska) with a valid Social Security number or ITIN, an active checking account, and a verifiable source of recurring income to use this service.
By submitting an application, you authorize Superior Funding to share the information you provided with our network of partner lenders for the purpose of evaluating your eligibility. You also authorize lenders to perform a soft credit inquiry, which does not affect your credit score. A hard inquiry will be performed only if you accept a specific loan offer.
You represent that all information provided in your application is true and accurate to the best of your knowledge. Knowingly providing false information is fraud and may result in denial, revocation of any approval, and possible legal action.
Submitting an application through Superior Funding does not guarantee that you will receive a loan offer. Approval is at the sole discretion of the partner lenders evaluating your application. Loan amounts, APR, term, fees, and all other terms are set by the lender, not by Superior Funding.
Loans available through our partner network range from $500 to $5,000. APR and term length vary by lender, applicant credit profile, state of residence, and other underwriting factors. Specific terms will be disclosed by the lender before you sign any loan agreement. You are not obligated to accept any offer.
You agree not to use the site for any unlawful purpose, to misrepresent your identity, to interfere with the security of the site, or to scrape or harvest data through automated means. We reserve the right to refuse service to anyone violating these terms.
All content on superiorfundding.com, including text, images, code, and design, is the property of Superior Funding or its licensors. You may not reproduce or distribute any portion of the site without explicit written permission, except for personal, non-commercial reference.
The site and its content are provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Superior Funding shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or any loan obtained through our partner network. Our total liability shall not exceed $100 or the amount you paid us in the twelve months preceding the claim, whichever is greater. Since our service is free to borrowers, this typically means $100.
You agree to indemnify and hold harmless Superior Funding, its officers, employees, and agents from any claims arising from your use of the site or your violation of these terms.
By providing your email address and phone number on the application form, you consent to receive electronic communications from Superior Funding and from the partner lenders that respond to your application. These communications may include application status updates, offer notifications, customer service messages, and account-related notices. We do not send marketing communications unless you have explicitly opted in to receive them, and you can opt out of any non-essential communications at any time using the unsubscribe link in any email or by replying STOP to any SMS message.
Notices from Superior Funding to you may be delivered by email to the address you provided, by SMS to the phone number you provided, by mail to the address you provided, or by posting on the site. You agree that electronic notices have the same legal effect as paper notices. You are responsible for keeping your contact information current with us, and notices sent to outdated contact information you failed to update are nonetheless considered delivered.
Our handling of your personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms of Service. By using this site, you also agree to the practices described in the Privacy Policy. Material changes to the Privacy Policy will be communicated through the same channels as changes to these Terms of Service, and continued use of the site after such changes constitutes acceptance of the updated practices.
Superior Funding does not knowingly collect personal information from individuals under eighteen years of age (nineteen in Alabama and Nebraska). If you become aware that a minor has submitted information to us, please notify us immediately so that we can delete the information from our systems and prevent further collection.
Superior Funding shall not be liable for any failure or delay in performance of its obligations under these Terms of Service that results from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, governmental actions, war, terrorism, civil unrest, labor disputes, pandemic, or interruption of utilities or telecommunications services. We will use commercially reasonable efforts to resume normal operations as quickly as possible following any such event.
These terms are governed by the laws of the State of Georgia, without regard to conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Fulton County, Georgia, unless applicable consumer protection law provides otherwise.
We may modify these terms at any time by posting the updated version on this page. Material changes will be communicated through prominent notice on the site. Continued use after changes constitutes acceptance.
We reserve the right to suspend or terminate access to the site at any time, with or without notice, for any reason including violation of these terms.
